The patents are expired. Anyone can use the ideas.

Copies have been made for quite a while. Mexican and Asian most notably. Unfortunately not all are of the original quality.

Some barely function, though there was a fair quality copy of the "Max" about 8 or 10 years ago in Guadalajara. Dunno if it's still around.

The use of the name can probably be protected... but policing stuff on Ebay takes some effort.

It's the name that is the problem. If they call it something similar it's one thing. Calling it the same thing as the original is quite a different story. Adds a whole new level of danger to the old "buyer beware".
